On August 28, the Metropolitan Magistrate court in Andheri accepted the police’s B-summary report. This decision followed the police’s assertion that their investigation had revealed the case to be a deliberate false accusation against the 48-year-old defendant.

A B-summary report is presented in court when there is a lack of evidence or a prima facie case against the accused. It is also used when a complaint is deemed frivolous or maliciously false by the magistrate.

Background of the Case

The case originated from a complaint filed by the actor, leading the Juhu police to register a case under relevant sections of the Indian Penal Code, including charges of rape, unnatural sex, and cheating. The complainant alleged that the accused had enticed her with the promise of marriage and subsequently sexually assaulted her at various hotels in the United States and Mumbai between March 2020 and February 2021. Additionally, she accused the defendant of deceiving his wife and son by falsely claiming their demise while they were alive.

Legal Defense and Response

The accused’s lawyer, Dinesh Gupta, contended that the woman had filed a false complaint as a form of retaliation, following a cheating case brought against her by his client. The defendant, previously employed as a senior maintenance officer with Qatar Airways, suffered professional consequences due to the false FIR.

Police Findings

In the B-summary report, the police stated that both the plaintiff and the accused were of mature age and had engaged in consensual financial transactions and physical relations. The woman failed to provide any evidence to substantiate her claim of meeting the accused through Facebook, as mentioned in her complaint. Moreover, no witnesses or material evidence were presented to indicate that the accused had forced sexual relations with her. The investigation yielded no such indications.

Conclusion of the Case

Based on these findings, the police concluded that the plaintiff had knowingly filed a false complaint against the accused. Their investigation pointed to the deliberate intent behind the false accusations, leading to the submission of the B-summary report to the court.

Court Verdict
